Does Paypal offer any Seller protection?

Sellers should know that paypal allows chargebacks for  usually any reason. We sold our course for 249.00
after which, the person paid using paypal. Paypal is supposed to be secure but it really isn't. Two weeks later, of course, after we had shipped the package. The person,
then, applied for a chargeback, claiming that they didn't authorize the purchase.

Why did they wait for so long before they applied for a chargeback? If paypal sent you a $250 bill would wait 2 weeks before you applied for a chargeback?

I doubt it?

At first paypal seems like they are your friend, but really they're not. Notice they even spell my name backwards like a credit card.

This is what they wrote:



Dear Slade David,  (name is backwards)

We've received your documentation and will keep it on file. We're currently reviewing this chargeback and your account. Please allow us 30 days from the date of the chargeback to complete our investigation and determine an outcome. If we dispute the claim, we will use the information you provided plus any evidence we may already have to investigate the chargeback with the buyer's credit card company. We will
contact you by email if any further information is needed.
 


In this case I provided as proof emails from the 3rd party, and proof of  delivery. I even have the buyers signature showing that they picked up the goods.

Paypal later said:




It is PayPal's standard practice to dispute unwarranted chargebacks. Using the information you provided, we are in the process of disputing this chargeback with the buyer's card issuer.

Because the card issuer has reversed this charge, PayPal is temporarily holding an amount equal to the disputed funds until this matter is resolved. If the card issuer decides the case in your favor, the funds will be available in your PayPal account.

The credit card company has charged PayPal a settlement fee for this chargeback. In accordance with the terms of the PayPal User Agreement, we have debited your PayPal account to cover this fee.
 


Notice here that they say that they will fight unwarranted chargebacks. But in the same breathe they don't expect to win. Why? Because the card issuer has already reversed the charges even before the case was decided.

Notice too, that they automatically hold your money and charge you to cover the settlement fee. In this case they couldn't because I had already withdrawn the money.

Notice they also pretend to be your friend. But they are not.

Obviously no evidence would have been enough, the reason is that paypal blames the credit card company and allows them to make the final decision - whether right or wrong. They accept the credit card companys decison and claim no responsibility.

They wrote:



 
Thank you for contacting PayPal.

Credit card companies grant their members specific consumer protections. Your buyer chose to take advantage of those rights. PayPal has no authority to replace or reduce any customer s rights. They are guaranteed by the Credit Card Company as well as applicable laws.

The decision to allow the Chargeback was made by the buyer�s card issuer, not PayPal. While we help you fight Chargebacks, we do not control the final decision in such cases.

Again, please understand that PayPal does not control the outcome of the Chargeback decision reached by the buyer's issuing bank in a credit card transaction. We will pursue your interests under the terms and conditions governing Chargeback reversals.





And guess what?

Their user agreement does state this:



It says:
�You acknowledge that PayPal does not control the outcome of any reversal decision initiated through a User's credit card issuer.�



Notice here, they are powerless help you win!  The final decision is not even theirs to make!  And they have protected their ass really well. You as a seller have no rights. In fact up to this day I don't even know which credit company they used.

Moreover they won't provide you with all the evidence.

When I complained to BBB and asked paypal for their tracking evidence this is what they wrote:

Dear Slade David, I reviewed your second inquiry to the Better Business Bureau regarding a Chargeback Reversal in the amount of $248.00 USD. Please allow me to offer further explanation. Credit card companies grant their members specific consumer protections which PayPal has no authority to replace. We disputed the Chargeback on your behalf, but we were not successful at recovering the funds. Unfortunately, we have no further recourse to pursue the matter on your behalf. If you need information that we have for the buyer, we would need to be presented with a subpoena.


In most cases, the burden of proof is on the seller to prove delivery to the buyer's address provided to you.

 
You were provided with a US shipping address, but your tracking shows you sent the item to Malaysia. For your own protection, please refrain from shipping merchandise to an address other than the one provided on the PayPal Transaction Details page. Again, we regret you have had this experience. 
 


Notice here, that because I sent the package to their daughter in Malaysia, (upon their request to do so) that this was good enough reason for them not give me a judgement award.

Does this prove that I made an unauthorized transaction?
No, In fact, they are acknowledging that i sent the package.

But really the big question is: Where was the purchase made from? The tracking information would have shown this and they aren't releasing it. Why not?

Notice to get that information I would need to fight them court with a
subpoena .

What do you think? Does paypal have any power to help the seller ? The answer is obvious, no!
